The regular meeting of the Lee Town Board was held in the Town Hall, and was called to order at 7:32 PM.

 

Present were:  Supervisor John Urtz, Councilmen Karl Matt, Alan Trombley and Josh Szyper.

 

Also present: Town Attorney, David Rapke and Highway Superintendent, Bill Baker.

 

Absent:  Councilman Joe Goetz.   

 

The meeting opened with the pledge of allegiance.

 

A motion was made by Alan Trombley, seconded by Karl Matt and carried to dispense with the reading of the minutes of the previous meeting.

The first order of business was to open sealed bids for approximately 20,000 gallons of low sulphur fuel to be used in highway equipment for the period of February 10, 2016 through January 31, 2017:

A motion was made by Alan Trombley, seconded by Karl Matt and carried to award the bid to Mirabito Energy Products at a fluctuating price of $1.3005 per gallon.  Bid is specified to be State Bid minus .015.

Old Business

 

Attorney David Rapke commented that it is anticipated the City of Rome will be submitting the corrections for past water billing issues by February 19th; in turn, the Town will issue a check to the City for the corrected figures.  A motion was made by Karl Matt, seconded by Josh Szyper and carried to authorize Supervisor Urtz to review the invoice and move forward with payment.

A motion was made by Josh Szyper, seconded by Alan Trombley and carried to advertise for the following bids to be opened at 7:30 pm on March 8th:

  • Three year contract (2016 – 2018) for landscaping/mowing the Lee Town Park, Trooper Barracks and the Lee Town Hall. 
  • Lee Town Park Custodian for the 2016 season.

Modifications to the Procurement Policy has continued to be tabled.

 

A motion was made by Alan Trombley, seconded by Josh Szyper and carried to hold a Public Hearing at 7:00pm on March 8th to review proposed zoning additions and modifications which include:  Solar Energy, Geothermal and wind power, corner setback definitions, height restrictions on structures.

The Planning Board has reviewed these modifications and submitted the following verbiage to be used in relation to corner setbacks, “On a corner lot the side yard setback is to be the same distance as established for the front yard setback on existing highways.”

 

Ed Davis of the Town’s Planning Board spoke of Mr. Miller’s, of the Amish community’s, request to establish a private cemetery.  Mr. Davis inspected the proposed area and did extensive research with various agencies including the NYS Department of Health and the NYS Division of Cemeteries; based on the findings from such review the Planning Board has reported to the Town Board they have no issues with the development of the private cemetery.

 

The area where the cemetery is proposed to be located is off Belcher Rd. Extension, which is an R-A Zone; there is no permitted use for cemeteries currently in our Zoning Ordinance, so a use variance will have to be applied for by Mr. Miller with the Zoning Board.

 

 

New Business

 

 

A proposal regarding Hydrogeologic/Groundwater development was submitted to the Town from “HydroSource Associates, Inc.” out of Ashland, NH. At the request of Town of Lee current engineer Jack Dodson.  Board members were given a copy for review and to consider if they would like to move on to phase I at a cost of $16,900.  Supervisor Urtz stated that he was notified by Plumley and Associates of their interest in submitting a proposal as well.

 

The NYS Association of Highway Superintendents has requested Towns adopt a resolution which will make state funding and resources available for local roads and bridges and to increase CHIPS funding in the 2016-17 state budget.  A motion was made by Karl Matt, seconded by Alan Trombley and carried to support the resolution “Local Transportation Funding”.

The Tappet Twirler have requested use of the park once again this year for the car show, which will be held on Sunday, August 7th.  Permission is granted as long as liability insurance is provided.  They also request to set up on Saturday the 6th to the west of the parking lots; Board Members denied this request as they have done in the past.  That area is for pavilion reservations.  Once the people are no longer using the pavilion for the day, they may go in to set up.

 

Town Clerk Sharon Mortis announced that she responded to a litigation settlement regarding monitors or computers purchased between 1999-2006.  After researching eligible items, a claim was submitted and the Town was disbursed $391.41 from the Office of the Attorney General.

 

Highway Superintendent Bill Baker announced that we will be hosting an MSHA training session at the Town Hall on April 7th for various highway departments etc.

 

A motion was made by Karl Matt, seconded by Alan Trombley and carried to approve and pay the bills.
