The regular meeting of the Lee Town Board was held in the Town Hall, and was called to order at 7:30 p.m.

 

Present were: Supervisor John Urtz, Councilmen Alan Trombley, Kevin Gallagher, Karl Matt, and Harold VanWagenen

 

Also Present: Town Attorney David Rapke and Highway Superintendent Bill Baker.

 

The meeting opened with the pledge of allegiance.

 

A motion was made by Alan Trombley, seconded by Karl Matt and carried to dispense with the reading of the minutes of the previous meeting.

Audience Portion

 

Gary Richardson of Main St. Lee Center came to the Board to express his concerns over what seems to be either a codes issue or possibly an issue of running an unauthorized business.  Mr. Richardson has a neighbor who has been running a garage/yard sale 24/7 365 days of the year.  He states there are disabled vehicles, old tires, bumpers, spools of wire etc.  These items are left out day and night and throughout the winter.  Mr. Richardson approached the Town Codes Officer last year in regards to this, but the Town has no ordinance concerning garage sales so there is no action that can be taken.  Board members had seen this and it looks as though it could be considered a codes issue and a cluttered way of keeping their property.  Board members discussed ideas such as creating an ordinance where residents must obtain a permit in order to hold a garage sale so that a time limit would be set, but this would have to come with inspections and penalties.  It was decided to start with having the Codes officer make a visit to the home to do an inspection first and in the meantime the Town will look into legislation on possibly creating an ordinance to address this issue.

 

Old Business

 

A motion was made by Karl Matt, seconded by Harold VanWagenen and carried to accept Justice Furney & Merrill audits performed by Business Consultants for the year 2014.

Councilman Kevin Gallagher reported that he has spoken with Rusty Martin and he will be meeting with him at the Town Park – Mr. Martin will be installing the playground equipment that was purchased last year.

New Business

 

 

Supervisor Urtz asked Board members to consider if they would like to have the tennis courts and basketball court resurfaced at the park which he believes will run about $8500 per court.  The stone wall that was budgeted for this year will not be done, so there is money to do this.  Quotes will be obtained.

 

Jason VonMatt of Hillside Seasonal has asked if he can store a piece of his equipment that he uses at the Town Park in one of the park buildings.  A motion was made by Karl Matt, seconded by Alan Trombley and carried to allow, pending a license contract to be drafted by the Town Attorney.

A motion was made by Alan Trombley, seconded by Harold VanWagenen and carried to declare the no longer used Pitney Bowes DM500 Postage Machine as surplus equipment.

A motion was made by Karl Matt, seconded by Kevin Gallagher and carried to authorize Town Clerk, Sharon Mortis to list the Pitney Bowes DM500 Postage machine with Auction Internationals.

Board members would like to modify the current ordinance to update the age of trailers that are allowed to be installed.  Attorney Dave Rapke will verse the language to state the year made must be 6 years or newer prior to the current year of installation.  A public hearing will be scheduled in the future.

 

The Town received a request from “Cycle Adirondacks” which is an organization that will be bicycling for one week beginning in Camden and ending in Saranac Lake; they have requested to use the Town Hall parking lot as their first “water stop”, where they will set up porta-potties and have water for the bicyclists.  A motion was made by Alan Trombley, seconded by Karl Matt and carried to allow this which will be on Wednesday, August 26, 2015.

A motion was made by Alan Trombley, seconded by John Urtz and carried to enter into the 2015 Ditching Agreement with Oneida County DPW.

It was announced the CHIPS reimbursement for this year was $155,534.85.

 

The Extreme Winter Recovery Grant $22,778.81.

 

A motion was made by Alan Trombley, seconded by Harold VanWagenen and carried to authorized Highway Superintendent Bill Baker to list the old chipper with Auctions International; no less than $7500 will be accepted.  The new chipper is expected to be here around the 1st of June.

Mr. Baker reported that Gorman Bros. plan on starting the paving the housing developments and the Town Hall loop on June 15th.

 

Mr. Baker also informed the Board that the 36” culvert on Wilkensen Rd. has rusted out and there is a sinkhole.  His plans are to replace the 33’ culvert on Thursday the 14th with 40’ of pipe.  They will be replacing the culvert on Mitchell Rd.  The part that is deemed abandoned by the Town back in 1964 was from where the tower site is .77 miles to where it joins with the Annsville line.  This was a 4-rod road.

 

Grievance Day will be on May 26th from 4PM until 8PM.

 

The Youth Program at Lee Town Park will begin and end 1 week later this year which will run July 13th through August 21st. 

 

Town Attorney David Rapke reported that the Town had received a draft contract from the City of Rome and negotiations are underway.  Board members had met for a Special Meeting on April 30th and have submitted some comments back to the city.
