The regular meeting of the Lee Town Board was held in the Town Hall, and was called to order at 7:33 PM.

Present were:  Supervisor John Urtz, Councilmen Kevin Gallagher, Patrick Hetherington, Alan Trombley, and Karl Matt.   

 

Also present:  Highway Superintendant, Bill Baker and Town Attorney, David Rapke.

 

The meeting opened with the pledge of allegiance.

 

A motion was made by Alan Trombley, seconded by Karl Matt and carried to dispense with the reading of the minutes of the previous meeting.

Supervisor Urtz announced the public portion of the meeting. 

Mary Byrne of 6078 Hawkins Corners Road was in attendance to discuss dog control.  Mrs. Byrne stated that she and a couple of her neighbors called the dog warden to report a stray dog in the neighborhood, but did not receive a return call.  Mrs. Byrne was troubled that the dog warden would not come to the scene unless law enforcement was present.  Supervisor Urtz responded that law enforcement is requested to be involved, in case the dog has been dropped off, because that may be considered abuse.  Councilman Patrick Hetherington suggested that the dog control officer be contacted and asked to respond to phone calls in a more timely manner.

 

Attorney David Rapke reported that the 3rd draft of the Time Warner Cable agreement has been disseminated to Board members.  A motion was made by Patrick Hetherington, seconded by Kevin Gallagher and carried to accept the agreement, contingent upon correction made on page 13, section 9A currently referencing 2.9 for gross revenue be amended to 2.10 for gross revenue.

A motion was made by Alan Trombley, seconded by Karl Matt and carried to reappoint:

  • Planning Board - L. James Jones Jr. (7 year term) 01/01/14 - 12/31/2020
  • Zoning Board - David Bergstrom (5 year term) 01/01/14 - 12/31/18

Highway Superintendant Bill Baker reported that the old sander broke; the bottom fell out and the chain broke, which left the department short on equipment.  A motion was made by Karl Matt, seconded by Alan Trombley and carried to allow for an emergency purchase of a new sander at a cost of $12,739 from Tracy Road Equipment.

Mr. Baker also reported that the new F550 pickup is in use and is working very well.  A motion was made by Alan Trombley, seconded by Patrick Hetherington and carried to contract Auctions International to take care of auctioning off the F350 without the sander.

Councilman Patrick Hetherington reported that the equipment ordered for the park, which includes benches, bleachers and playground equipment is scheduled to be delivered tomorrow 12/11/13.  A motion was made by Patrick Hetherington, seconded by Alan Trombley and carried to authorize payment of these items on the December abstract so it is finalized in the 2013 budget.

Supervisor Urtz announced that the Town's current banking facility, Berkshire Bank, will no longer be handling municipal accounts; the Town will be looking into an alternate bank.

 

Councilman Karl Matt stated that doors for the front of the Town Highway garage are on order at a cost of $2700.

 

Councilman Kevin Gallagher reminded of the need to advertise for a Town Historian.  Mr. Gallagher also reported that he has been pricing biodegradable bags from different vendors for next season.

 

Councilman Patrick Hetherington stated that he has been in contact with Mickey Deitrich from the Tug Hill Commission regarding the digital mapping software, and training of town employees will be postponed for the time being.

 

Mr. Hetherington addressed those present to express his thoughts and appreciation regarding his 4 year term as councilman which is ending this year. 

Bill Baker announced that repair work was done on the garage doors at the new storage building because the springs had broken.  Mr. Baker will notify the engineer Tim Hogan to have contractor cover charges.

 

A motion was made by Alan Trombley, seconded by Patrick Hetherington and carried to approve and pay the bills.
