The regular meeting of the Lee Town Board was held in the Town Hall, and was called to order at 7:41 PM, following a Public Hearing regarding William J. Baker's application to appeal for a Special Use Permit.

 

Present were:  Supervisor John Urtz, Councilmen Kevin Gallagher, Alan Trombley, and Patrick Hetherington.   

 

Also present:  Highway Superintendant Bill Baker and Town Attorney, David Rapke.

 

Unable to attend:  Councilman Karl Matt

 

A motion was made by Alan Trombley, seconded by Kevin Gallagher and CARRIED to dispense with the reading of the minutes of the previous meeting.

Regarding the request by William Baker of 6297 Stokes Westernville Rd. to demolish and build a new residence:  A motion was made by Councilman Patrick Hetherington, seconded by Alan Trombley and CARRIED to approve the application to reestablish the nonconforming use; contingent upon the

§ 239-L&M to be received from the county.  All in favor.

 

Ed Davis of Felton Ave. was in attendance and thanked the Board for their contribution to the 100th Anniversary of Delta Dam.  Supervisor Urtz acknowledged all the hard work Mr. Davis did and that he did a terrific job.

 

Pete Lamonica of 9020 Turin Rd., who also owns 9000 Turin Rd. informed the Board that he has put up a 7' fence that runs 200' bordering his property.  This was done primarily to "serve as a method to protect the public health, safety, welfare and convenience of the surrounding neighborhood and community; both residential and commercial properties".  Mr. Lamonica states this was done in good faith.  This is in regards to the noise complaints from neighbors of All Creatures Boarding & Grooming who rented the property at 9000 Turin Rd.  Councilman Hetherington agreed with Mr. Lamonica that the 28 months that this has been going on is frustrating.  Town Attorney Dave Rapke reported that we are still awaiting a decision from the judge regarding the Article 78.

 

The Town Planning Board has recommended some revisions to the Town of Lee Subdivision Regulations, which is tentatively Local Law #3 of 2012.  There was a lengthy discussion regarding Section C, #1 which states, "The Developer filing with the Secretary to the Planning Board the consents of all record lot owners within the affected subdivision to the modification(s) as proposed".  Board members questioned whether requiring the residents in a subdivision to 100% agree on any modification(s) is a good idea.  Ed Davis and Pete Lamonica, both of the Planning Board explained their reason for recommending this to be done.  Town Board members suggested possibly using a high percentage of resident votes or super majority, rather than 100%.  Councilman Patrick Hetherington suggested that both the Town Board & Planning Board have a meeting to discuss this further.  This was agreed - meeting to be scheduled by Sharon Merrill.

 

Documentation was received from the City of Rome of their intent to serve as lead agency regarding performance standards applicable to vibrations.  The City has asked if the Town of Lee has any objection or comments.  Board members had no objections.

 

Oneida County agreement for Snow & Ice control has been TABLED for this month's meeting.

 

Supervisor Urtz announced that 2013 budget requests are due by 9/15/12, Board members will schedule a meeting following that date.

 

Councilman Hetherington commended Bill Baker and the Highway employees on the great job they are doing with the trails at the Town Park.  Mr. Baker stated that Bill Trudell has volunteered his time to run the dozer on the trail work and he did a wonderful job.

 

Councilman Gallagher announced the 3rd annual White Goods Day to be held on Saturday, 9/15/12 from 8AM until Noon at the Highway Garage.  This year Mr. Gallagher has arranged to also collect items such as old computers, printers, monitors etc.

 

Mr. Gallagher also stated that he has done some research on "puppy mills", which was discussed at last month's meeting.  He says he has seen some local laws from other Towns that may ‘fit' our Town and plans to put something together to present to the Board in the future.

 

Councilman Trombley stated that over the last few years, Kevin Gallagher has done an outstanding job with the Town clean-up days, and deserves some recognition. 

 

A motion was made by Alan Trombley, seconded by Kevin Gallagher and CARRIED to approve the bills.

General     -       $    98,489.38

                                    Highway   -      $    53,162.51

                                    Water        -      $      3,398.20

 

A motion was made by Alan Trombley, seconded by Kevin Gallagher and CARRIED to adjourn. The September 2012 Town Board meeting adjourned at 8:24 PM.
