The regular meeting of the Lee Town Board was held in the Town Hall, and was called to order at 7:31 PM.

 

Present were:  Supervisor John Urtz, Councilmen Kevin Gallagher, Alan Trombley, Patrick Hetherington and Karl Matt.

 

Also present was Town Attorney, David Rapke.

 

Highway Superintendent, Bill Baker.

 

The meeting opened with the pledge of allegiance.

 

A motion was made by Alan Trombley, seconded by Karl Matt and CARRIED to dispense with the reading of the minutes of the previous meeting.

 

Supervisor Urtz announced the decision made by the Planning Board at their February 7th Special Meeting:  The Board voted 6 to 1 in favor of allowing a single unit to be built in Raven Rock Estates.

 

It was also announced that the cold storage building for the highway garage was also put out to bid, with bids to be opened on March 13th, 2012 at 6 PM.

 

A motion was made by Alan Trombley, seconded by Kevin Gallagher and CARRIED to put out to bid 3500 +/- ton type 3 modified binder for the 2012 season.  Bids to be opened on March 13th, 2012 at 6:30 PM.  Projected roads include Harris Rd., Streun Rd., Maple Dr., Bork Ave., Felton Ave., and Turin Towne according to Highway Superintendant Bill Baker.

 

Councilman Patrick Hetherington submitted a proposed Health Insurance Policy for non-union employees.  Board members only received this proposal just prior to the meeting, so it was decided to table until they have had a chance to review.

 

The draft agreement between Little League and the Town of Lee has been received.  Town Attorney David Rapke commented that the biggest issue was that previously the Town could revoke at any time whereas now it is a 10-year contract which would expire in November 2021.  He also states that it would reduce the aggregate insurance from 1-3 million to 1-2 million.  Councilman Patrick Hetherington has requested that the "senior field" be added into the facilities portion of the contract.  A motion was made by Karl Matt, seconded by Kevin Gallagher and CARRIED to enter into agreement with Lee Little League pending above stated change.

 

A motion was made by Patrick Hetherington, seconded by Kevin Gallagher and CARRIED to execute the decision made by the Town Board on October 25, 2011 regarding All Creatures Boarding & Grooming Facility.  Attorney Dave Rapke will proceed with Article 28.

 

Books for the Water Department - year 2011 were reviewed and accepted by motion made by Alan Trombley, seconded by Karl Matt.  CARRIED

A motion was made by Alan Trombley, seconded by Kevin Gallagher and CARRIED to hold a Bicentennial Board Meeting on 3/3/12 at 1:00 on the 200th anniversary of the 1st board meeting.  A special meeting will be held at 6:00PM to open bids for the highway storage building, 6:30 to open bids for asphalt, regular meeting to be at 7:30PM on 3/13/12.

 

A motion was made by Alan Trombley, seconded by Karl Matt and CARRIED to accept the resignation of Walt Buhler from mowing of the Town Park.

 

Councilman Kevin Gallagher announced that the "Lee"Opoly board games will possibly be available by the March 3rd meeting.

 

A motion was made by Kevin Gallagher, seconded by Patrick Hetherington and CARRIED to revise the definition of "Ad Hoc" to state they can vote in the absence of a member.  Currently states can only be used if in need of a quorum.  Attorney Rapke will make a draft to amend Local Law #1 of 1991 to include both the Planning and Zoning Boards.

 

Councilman Gallagher suggests that a department be chosen each year to be audited by an accountant.  The Board was receptive to this idea.

 

Councilman Patrick Hetherington requests the financial report prepared by the Supervisor be submitted to the Board in a more timely fashion.  He states that the report given to him tonight was from 12/2011 and believes in order to approve the bills for the current month the Board should know the balances of the accounts.  Supervisor Urtz explained that the bank statements are not received in order to balance the books and have the reports ready any sooner than they are.  Mr. Hetherington was informed that the clerk has the information on the abstract if he would like a more current figure.

 

Highway Superintendant Bill Baker announced that the 6 ton weight limit as of 3/01/12 has been advertised in the newspaper; also that the official road map is in the process of being laminated.

 

A motion was made by Alan Trombley, seconded by Karl Matt and CARRIED to go into executive session regarding a personnel matter at 8:37 PM. 

 

The Board returned from Executive Session at 9:13 PM.

 

A motion was made by Alan Trombley, seconded by Karl Matt and CARRIED to pay the bills.

 

General     -       $   24,748.09

                                    Highway   -      $   36,530.98

                                    Water        -      $     4,912.50

 

A motion was made by Karl Matt, seconded by Alan Trombley and CARRIED to adjourn. The February 2012 Town Board meeting adjourned at 9:14 PM.
