September 13, 2011
The regular meeting of the Lee Town Board was held in the Town Hall, and was called to order at 7:30 PM.
Present were: Supervisor John Urtz, Councilmen Kevin Gallagher, Alan Trombley, Patrick Hetherington, and Karl Matt.
Also present: Highway Superintendent, Bill Baker and Town Attorney, David Rapke.
The meeting opened with the pledge of allegiance.
A motion was made by Alan Trombley, seconded by Karl Matt and CARRIED to dispense with the reading of the minutes of the previous meeting.
Bob Carrier of 113 Van Tassel Lane was in attendance to appeal to the Town Board to overrule the denial of Legend Developer's request to the Planning Board, which was to build a single family unit in Raven Rock Estates, pursuant to the Town of Lee Zoning Ordinance Section 111, Section 5. The Board responded that they will review the maps and await the transcript of the Planning Board meeting in order to make a decision.
Harlan Moonen from NOCCOG stated the Hazard Mitigation Plan will need to be updated and that JoAnne Humphries will begin this in the Spring.
Tim Dunn of Bailey, Haskell & LaLonde Insurance presented the Board with a proposal of $31,485.31 total premium. Supervisor Urtz has been working with several companies and more quotes will be forthcoming.
David Rapke informed the Board that he is awaiting a proposal from Mr. Tallerino from the City of Rome, in regards to their request to service Sleepy Hollow Rd. with city water.
Mr. Rapke also provided the Board with an Indemnification Agreement he has drafted for use by Mr. Steve Flanders. Mr. Flanders has requested use of the Park to lift off his hot air balloon. The Board will review the agreement and notify the Town Clerk by 9/16 of their approval/disproval.
A motion was made by Alan Trombley, seconded by Kevin Gallagher and CARRIED to hold a public hearing on 10/11/11 at 7:00 PM regarding Local Law #2 "Brush, Grass & Weeds Law".
Mr. Rapke informed the Board that he has sent correspondence to Attorney Paul Longeretta and resident Doug Singleton, to inform that the Town of Lee is not responsible to repair, maintain, or improve any private improvements within the highway right of way. Mr. Singleton had previously asked the Town to repair the gaps between the driveways and the roadways. Highway Superintendant Bill Baker had supplied Mr. Singleton with a written response stating the Town is not responsible.
Councilman Patrick Hetherington supplied the Board with a quote from Rome Sign for new "Welcome to Lee" signs. The Board plans to review and decide what materials they would prefer for the signs to be made out of.
Mr. Hetherington also spoke on behalf of the Little League in regards to them donating their building to the Town of Lee for insurance purpose. He states they are happy to do so, but would like to see the contract state they will have exclusive use of the building.
An invoice was received from the Rome Humane Society for a dog picked up by the Rome Dog Control Officer. Emergency surgery was performed on this dog and billed to the Town of Lee. The Town DCO had no involvement in this case and the Board has denied payment of invoice.
In regards to All Creatures Boarding & Grooming: Mr. Rapke informed the Board that the Supreme Court hearing scheduled for tomorrow has been adjourned. The judge hearing the case has requested transcripts from the Public Hearing held on 1/25/11 and 2/08/11. Only a recording of the January meeting could be found. It is Mr. Rapke's belief that Judge Shaheen will rule that another public hearing be held.
A motion was made by Alan Trombley, seconded by Karl Matt and CARRIED to pay the bills.

A motion was made Alan Trombley, seconded by Patrick Hetherington and CARRIED to adjourn. The September 2011 Town Board meeting adjourned at 9:14 PM.
